FuboTV's Lawsuit against Disney, Fox, and Warner is Set for an October 2025 Trial
FuboTV Inc.’s lawsuit against Fox Corp., Warner Bros. Discovery Inc., and Walt Disney Co. concerning their plans to launch a new sports-streaming service will go to trial next fall, which could delay the service's arranged debut before the next football season.
U.S. District Judge Margaret Garnett scheduled the trial to begin on October 6, 2025. Last month, Judge Garnett provided a preliminary order faltering the $42.99-a-month service, Venu Sports, from proceeding while the lawsuit is ongoing.
The media giants had planned to launch Venu on August 23, just before the start of the college and professional football seasons. As a result, even if the companies win the case, Venu will likely miss at least the early games. Judge Garnett specified that the trial is expected to last between three to four weeks.
Fubo, a smaller sports streaming service, filed the lawsuit in February, alleging that the larger media companies were using their control over major sports rights to unfairly influence the competition.
This lawsuit is part of a broader wave of legal disputes over valuable sports broadcasting rights as viewers increasingly shift from cable TV to streaming services.
Fox, Warner, and Disney contend that Venu would not harm competition, as they would still need to negotiate rights individually and compete for viewers across various platforms.
The Justice Department is also preparing to review the Venu deal due to concerns that it might negatively impact consumers and reduce competition among media rivals and sports leagues.
The case is FuboTV Inc. v. Walt Disney Co. et al., 24-cv-1363, in the U.S. District Court for the Southern District of New York (Manhattan).
